Legal update as of April 2017: Licensed premises exemption
The Immigration Act 2016 brought in a new power of entry for immigration officers, which took effect in 2017. It specifies that officers may enter premises without a warrant if they are licensed to sell alcohol or ‘late night refreshment’. Late night refreshment is defined as ‘hot food or drink’ between the hours of 11:00pm and 5am.
Places likely to be affected include takeaways, off-licenses, many restaurants, music venues – effectively anywhere selling alcohol or late night food.
